Data Processing Agreement

For the efficient execution of application procedures, we use an applicant management system from softgarden e-Recruiting GmbH, Tauentzienstr. 14, 10789 Berlin (Contact: datenschutz@softgarden.de), which operates the applicant management as a processor according to Art. 4 No. 8 GDPR. A data processing agreement has been concluded with the provider according to Art. 28 GDPR, which ensures compliance with data protection regulations.

For exercising your rights as a data subject and the handling of the application process, we remain your first point of contact. You can contact us directly using the above-mentioned contact details of the responsible party, or, where indicated, confidentially contact the data protection officer.

 

Subject of Data Protection

The subject of data protection is the processing of personal data, currently within the scope of applicant management. This includes all information relating to an identified or identifiable natural person (hereinafter "data subject") that is necessary for the conduct of the application process and the initiation of an employment relationship, § 26 BDSG.

Additionally, usage data related to the use of the applicant management system is also collected. Usage data includes data necessary for operating our websites, such as information about the start, end, and scope of use of our website, including login data. These processes are in accordance with data protection and telecommunications media laws.

During the application process and/or the use of the system, processing activities may take place, either based on legitimate interest according to Art. 6 Para. 1 lit. f) GDPR or based on your consent according to Art. 6 Para. 1 lit. a) GDPR. Processing activities that are subject to a legal obligation to process or a public interest, Art. 6 Para. 1 lit. c) and e) GDPR, such as in the context of law enforcement or investigations by state authorities, may also be considered. By individual settings in your web browser, the configuration of the corresponding cookie settings, and your user behavior, you can determine and control the extent of processing yourself.

 

Collection and Use of Your Data

Visit to the Website

For operational and maintenance purposes and in accordance with telecommunications media laws, interactions are recorded ("system logs"), which are necessary for the operation of the website or for purposes of system security, to analyze attack patterns or unlawful user behavior ("evidence function").

Your internet browser automatically transmits the following data during access to the career portal:

IP address of access.

These data are not used for direct personal identification within the framework of applicant management and are deleted after 52 days according to legitimate retention periods, unless longer retention is necessary for legal or factual reasons, such as for evidence purposes. In individual cases, retention for the aforementioned purposes may be considered. The legal basis is Art. 6 Para. 1 lit. f) GDPR and telecommunications media law.

 

Session Cookies

We store so-called "cookies" to offer you extensive functionality and make the use of our websites more comfortable. "Cookies" are small files that are stored on your computer with the help of your internet browser. If you do not wish to use "cookies", you can prevent the storage of "cookies" on your computer by adjusting your internet browser settings accordingly. Please note that the functionality and range of features of our offer may be limited as a result.

On the career page, we use the cookie JSESSIONID as a technically necessary session cookie. This stores a so-called session ID, which allows various requests from your browser to be assigned to the common session. This allows your computer to be recognized when you return to our website. Application Process

During the application process, after configuring a username and password, you can set up and manage an account on the career portal. You can use further options in the softgarden applicant management system beyond individual applications and make your individual settings (e.g., inclusion in a talent pool).

For an efficient and promising application, you can provide the following information as part of your application with us:

Profiles on social networks (e.g., XING, LinkedIn, Facebook)

Documents related to applications (application photos, cover letters, certificates, employment references, work samples, etc.)

The legal basis for processing for the purposes of carrying out the application process and initiating an employment relationship is § 26 Abs.1 Satz 1 BDSG and Art. 6 Abs. 1 lit. b) GDPR. Additionally, the use of the applicant management system by the responsible party is in the legitimate interest according to Art. 6 Abs. 1 lit. f) GDPR. If consent is required for a specific processing activity according to Art. 6 Abs. 1 lit. a), it will be obtained separately and transparently by the responsible party from you, unless it arises from a conclusive and voluntary behavior on your part, such as voluntary participation in a video interview.

 

Data Sharing

Your data are not shared with unauthorized third parties within the framework of applicant management and are processed for the purposes mentioned in this privacy policy. The inspection by internal departments and specialists of the responsible party is in the legitimate interest, to the extent that knowledge of the details from the application process is necessary and permissible for the selection of applicants or internal administrative purposes of the company. For this purpose, your details may be forwarded by email or within the management system to third parties within the company (including works councils) and the corporate group. The legal basis may be § 26 Abs. 1 BDSG, Art. 6 Abs. 1 lit. f), and a) GDPR.

The transfer to third parties also occurs within the framework of order processing according to Art. 28 GDPR, thus within the framework of processing activities in which the responsible party has a legitimate interest in outsourcing processing activities that he would otherwise be entitled to perform himself. The transfer to external third parties may also occur for the defense of legal claims based on legitimate interest or in the context of investigations or disclosures to state authorities, as far as a law prescribes this or an obligation to disclose exists. The information obligations towards affected persons according to Art. 13, 14 GDPR are ensured in advance of the respective transfer, as far as these are to be fulfilled separately.

 

Feedback Module

Accompanying your application, we may ask you for your feedback after an interview and 3 months after your employment. We will send you an invitation link that leads you into the rating system for submitting the feedback. The purpose of the processing is the further development and optimization of our recruiting and application processes and the company image.

The following data are processed automatically for this purpose:

Contact details (name, email)

Position title of the job you applied for

Location of the position

Job category

Applicant identification

The feedback itself is stored anonymously in the database. No personal reference is established. In addition to a star rating of individual questions, you have the opportunity to leave comments. We explicitly ask you not to leave any personal data in the comment. The information collected can be displayed along with your feedback on our rating page or transmitted to external partners such as kununu.

Participation is purely voluntary and only occurs with your consent, without which the submission of the feedback is not possible. The legal basis is Art. 6 Abs. 1 lit. a) GDPR.

 

Subscription to Job Advertisements "Job Subscription"

To be informed about new job offers, you can subscribe to the job newsletter or display suitable positions on our career board (RSS feed). You can specify the subscription by providing details about the desired activity and location.

Additionally, providing your email address is required for the subscription. The legal basis for this is your consent to receive the newsletter according to Art. 6 Abs.1 lit. a GDPR. You can revoke your consent to receive the newsletter at any time via the unsubscribe link in the newsletter (Opt-Out).

No personal data are processed via the RSS feed itself to inform about new job advertisements.

 

Talent Pool

As part of your application or via the "Get in Touch" button, you have the opportunity to recommend yourself for our talent pool. The processing is necessary to automatically consider you for further job postings, for similar or otherwise suitable positions.

If you register for the talent pool via the "Get in Touch" button, the following information is requested:

Title, academic degree (optional)

First name, last name, email address

Job fields of interest

Current career stage

Preferred location(s)

XING profile or resume

Joining the talent pool occurs on a purely voluntary basis with your consent and through the use of an opt-in link. The legal basis is Art. 6 Abs. 1 lit. a) GDPR. Your data remain in the talent pool for 24 months. After this period, we will ask you if you agree to storage for another 24 months. If you do not give your consent, your data will be deleted from the talent pool after 2 weeks.

 

Deletion and Use of Data

Your data are stored for the duration of the application process and according to legitimate retention periods after the conclusion of the application process. In the event of a rejection, the data are retained for 4 months. After the retention period, the data are completely anonymized. The processing of anonymized data sets does not fall under the substantive scope of the data protection regulations, so anonymized data can be processed for statistical and analytical purposes, for creating market studies, or for product development.

 

Your Rights as an Affected Person

Rights of affected persons

Affected persons are entitled at any time to find out whether their personal data have been stored, and can exercise a right of access to stored data (right of access), verify their accuracy (right to rectification), demand their supplementation and update, request their deletion (right to be forgotten), request the restriction of processing (right to restriction), and have the data ported in a common, machine-readable format (data portability). These rights apply unless compelling and/or legitimate reasons on the part of the responsible party oppose them. Please contact the above-mentioned contact details for this purpose.

In cases where we process data based on your consent (Art. 6 Abs. 1 lit. a) GDPR), you have the right at any time to revoke your consent without giving reasons and with effect for the future. The corresponding data processing will then no longer take place in the future, but this does not affect the legality of the processing up to the point of revocation. In addition, within the scope of legal requirements, you have the right to object to processing, for example, if the data were processed erroneously or if other reasons in the interest of the affected person oppose further processing. Affected persons also have the right to complain to the supervisory authority responsible for data processing.

Please note that in the event of an objection and/or revocation, certain services/processing activities may not take place or be utilized, as far as the processing is necessary for these purposes.

 

Automated Decision-Making

Automated decision-making does not take place. Should this be necessary or become necessary, we will obtain transparent consent in advance of the processing at the appropriate time.
